These Terms and Conditions ("Terms") govern your access to and use of the ByHandling order tracking platform, APIs, dashboards, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, joining the waitlist, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced within them.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of the Service
ByHandling is a multi-tenant order tracking and post-purchase platform that lets B2B clients create orders, manage delivery status updates, and expose read-only tracking experiences to their end customers.
We may add, modify, or discontinue features at any time. The Service is offered on an evolving basis, and some capabilities may be limited during private beta.
3. Accounts and Access Tokens
Access to the Service is controlled through a decoupled token model. You are responsible for safeguarding all credentials and tokens issued to you, including order management tokens, operational action tokens, and consumer tracking tokens.
You are responsible for all activity that occurs under your account or tokens. Notify us immediately if you suspect any unauthorized use.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:
- Attempt to access data belonging to another tenant or circumvent multi-tenant isolation.
- Reverse engineer, probe, or disrupt the Service or its infrastructure.
- Use the Service to transmit unlawful, infringing, or malicious content.
- Exceed documented rate limits or abuse the API in a way that degrades the Service for others.
5. Carrier Credentials (BYOC)
The Service uses a Bring Your Own Credentials (BYOC) model. You are responsible for providing valid developer API credentials for the carriers you connect, and for complying with each carrier's own terms of service.
We use your credentials solely to provide the Service on your behalf and handle them in accordance with our security practices.
6. Data and Privacy
You retain ownership of the data you submit to the Service. You grant us a limited license to process that data for the purpose of operating and improving the Service.
Our handling of personal data is described in our Privacy Policy. You are responsible for ensuring you have the necessary rights and consents for any personal data you submit.
7. Intellectual Property
The Service, including its software, design, and documentation, is owned by ByHandling and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Delivery estimates and tracking information are provided on a best-effort basis and may depend on third-party carrier data.
To the maximum extent permitted by law, ByHandling will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
9. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which ByHandling is established, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
